An OnlyFans model in a legal battle with a billionaire Democrat donor after their tempestuous break-up has removed her claims of rape in a new legal filing.

The change was made after DailyMail.com revealed texts in which the former Playboy porn star, Stefanie Gurzanski, 26, appeared to refer to her sexual encounter with Stephen Cloobeck, 59, as consensual.

The legal climbdown comes as Cloobeck, founder of the Diamond Resorts timeshare firm, launched a new federal lawsuit against Gurzanski accusing her of copyright infringement for selling nude pictures of herself taken on his property.

In the past few weeks Cloobeck registered copyrights to 27 pictures and three videos shot by the model’s friend Adrianna Suchor, of Gurzanski naked straddling a horse, writhing on the sand, posing in a bikini on a yacht and on a balcony overlooking the sea, and standing above the camera in a short skirt while holding a golf club on a putting green.

In a court filing obtained by DailyMail.com, Cloobeck claims that ‘without authorization, Gurzanski reproduced and distributed the Works on Gurzanski’s social media accounts,’ including her OnlyFans, Instagram, Twitter and TikTok pages.

The federal suit is the latest litigation in an all-out legal war between the former couple after they ended their six-month relationship in December 2020.

The Diamond Resorts founder claimed Gurzanski tricked him into believing she was a fashion model, when he said in fact she made her living selling pornography on the subscription site OnlyFans, and used his mansions and private jet as a backdrop for her X-rated shoots without his permission.

Cloobeck sued Gurzanski in January, claiming she is a ‘con artist’ who bilked him for $1.3million in gifts over their roughly six-month relationship.

The same month, the model obtained a temporary restraining order against the mogul, claiming he had been harassing her and threatening to destroy her life with legal attacks, and filed police reports against him.

Her lawyer also claims Cloobeck knew the truth about her modeling background from the start.

In September Gurzanski filed a bombshell counterclaim, alleging that the billionaire had forcefully performed oral sex on her against her will the first night they met, then lavished her with $70,000 of Louboutin shoes the next day to ‘make up for raping her’.

But DailyMail.com revealed texts from the time between the model and a ‘professional matchmaker’ who connected her with Cloobeck, which appeared to tell a different story.

The day after the alleged July 2020 incident, Gurzanski wrote: ‘I let him go down on me’, ‘I wanted to give him a taste so he would want more’, and ‘he’s super nice and I’m down for the situation and I think he is too that’s why I let him go down on me and he came in like two seconds from me touching him lol.’

She made clear in the texts she expected rewards from her new lover to continue the relationship, writing to the alleged matchmaker, Catherine Le, that she was ​​’looking for someone to do like rent and gifts. Lots of gifts tho.’

Her lawyer, Arthur Barens, told DailyMail.com that his client referred to the sexual encounter as consensual in her texts because she wanted to ‘save face’ with Le.

‘She was extremely embarrassed about what happened to her and the suddenness and abruptness of the way Cloobeck exploits her,’ he said. ‘She is trying to save face with her girlfriend.’

Gurzanski’s legal filings said she was ‘left confused and disoriented in Cloobeck’s wake and to understand and rationalize what had just been done to her by the self-proclaimed man of almost limitless wealth and political power’ and ‘like many abused individuals who do not believe that they could have been in such a situation, she did her best to rationalize and excuse what happened.’

But Barens filed an amended cross-complaint on Friday which removed the allegations of ‘assault’ and ‘battery’ from her original filing.

A side-by-side analysis of the two documents shows Barens changed a reference to Cloobeck as a ‘sexual predator’ to just a ‘predator’ and removed a claim that he was ‘grooming’ Gurzanski.

A description of Cloobeck performing oral sex on the model the first night they met remains in the updated document, but the lawyer removed the claim that it was ‘without permission or consent’ and deleted her explanation of feeling ‘confused and disoriented’ and how she ‘did her best to rationalize and excuse what had happened.’

Gurzanski also kept the description of Cloobeck’s subsequent opulent gifts of $70,000 in Louboutin shoes, a diamond Cartier watch, ‘hundreds of thousands of dollars of gifts from Chanel’ and ‘expensive Hermes Birkin handbags’, but removed the claim that they were a ‘peace offering’ to ‘make up for raping her’.

Her new legal filing kept in claims that ‘when Cloobeck’s anger flared, Ms. Gurzanski would seek solace and respite from Cloobeck’s outbursts in the Woman’s Closet’ – a private wing off his master bedroom – and that ‘the Woman’s Closet was not truly private and Cloobeck could burst in whenever he wanted, often while nude.’

However, the lawyer deleted the claim that Cloobeck ‘stripped down nude and invaded the Women’s Closet demanding that Ms. Gurzanski due [sic] as he desired and provide Cloobeck with sexual contact and relief.’

He also deleted another claim of sexual assault, in which Cloobeck allegedly ‘forcibly grabbed Ms. Gurzansky [sic] by the wrists and, using brute force, maneuvered Ms. Gurzanski’s hand on Cloobeck’s naked penis.’

Barens kept in his filing quotes of Cloobeck’s allegedly threatening texts to Gurzanski’s friend Suchor in which the self-proclaimed billionaire wrote: ‘Today was a small taste of what the next three years are going to be like… This will mentally take over her life… Tell her to have her attorney call mine and settle. Otherwise she’s gonna see nasty legally quick. No joke. It’s gonna be her worst nightmare.’

Barens told DailyMail.com the amendments were not because of the texts DailyMail.com revealed, but because Gurzanski could no longer rely on Le as a witness after she partnered with Cloobeck in a new cosmetics business in Nevada.

‘I believe that she will most likely say whatever she is directed to say by the puppeteer, Cloobeck,’ the model’s attorney said.

Le told DailyMail.com that although Cloobeck had invested in her new firm, it was because he liked the products. She said she never discussed the legal case or allegations with him or Gurzanski, and that she had not been pressured or persuaded to make any statements.

Le added that although she received gifts from Cloobeck to introduce him to Gurzanski, she was not a ‘professional matchmaker’ but instead a real estate investor and skincare entrepreneur.

Cloobeck’s lawyers at Glaser Weil Fink Howard Avchen & Shapiro LLP also filed a new court document on Friday: a federal complaint alleging copyright infringement by Gurzanski and Unruly, the influencer agency representing her.

The lawsuit claims that between September 17 and October 7, 2021 the timeshare mogul secured copyrights with the US Copyright Office to 27 photos and three videos of Gurzanski shot by Suchor during the model and mogul’s relationship last year.

He claims ‘Neither Plaintiff nor Suchor authorized the reproduction of any of the Works’, and that ‘Without authorization, Gurzanski reproduced and distributed the Works on Gurzanski’s social media accounts, including Twitter (@Ste_FAN_ie_Gurz), Instagram (@stefaniegurzanski), OnlyFans (@stefbabyg) and TikTok (@stefbabyg).’

Cloobeck also claimed Unruly put the photos on its website and Instagram page without permission.

The photos, attached as exhibits with the court filings, show the model posing with a tennis racquet on a court while pulling up a crop top to expose her breasts. She poses in various bikinis, one on a lawn in front of a mansion and another with a golf cart emblazoned with her OnlyFans nickname ‘Baby G’.

Other shots include her lounging on a yacht, and on a beach spread-eagled bareback on a horse.

One clothed picture shows her posing on the seats of a private jet, which Cloobeck claims was taken on his plane.

Another cheeky shot is taken from ground level looking up Gurzanski’s white skirt as she walks across a putting green, golf club in hand.

Cloobeck’s lawyers also attached to the filing screenshots of some of these photos used as a background on her page on the Unruly website, and posted on their Instagram account.

Barens said the new federal lawsuit was a bullying tactic by the well-connected billionaire.

‘He is committed to ruining her life. He made that clear in his earlier texts. This is all part of him executing that plan,’ he told DailyMail.com.

‘The additional copyright suit that Cloobeck has filed as part of this continuing harassment of Stefanie, her friends, her family, her business associates, anyone that has anything to do with Stefanie.

‘He is going to cause them to have to get lawyers, be in litigation, threatened with depositions, threatened with subpoenas for records.

‘I suppose he has nothing better to do with his life than copyright young girls’ pictures. He can then keep them at home and entertain himself. I guess that’s what he does.’
